These Terms & Conditions apply to all services provided by Nest AuPair Agency relating to au pair placements, mediation and support services in accordance with Dutch laws and regulations governing the au pair programme.

Hereinafter referred to as “the agency”. By using the agency’s services, host families and Au Pairs agree to these general Terms en conditions.
2. Definitions
For the purpose of these General Terms & Conditions, the following definitions shall apply:
• Agency: Nest AuPair Agency
• Host Family: the family applying to host an au pair.
• Au Pair: the participant joining the cultural exchange program.
• Placement: the match and stay between the Host Family and the Au Pair.
• Services: all mediation, support, documentation and guidance services provided by the Agency.
• IND: The Dutch Immigration and Naturalisation Service.
3. Nature of the Services
The Agency provides mediation and support services between host families and au pairs in accordance with Dutch au pair regulations.
The au pair program is intended solely for cultural exchange and is not an employment relationship.
The Agency assists with:
• Matching host families and au pairs
• Guidance during the application process
• Administrative support
• Visa and IND guidance
• Mediation and support during the placement period
The Agency cannot guarantee a successful match, visa approval or long-term compatibility between the Host Family and the Au Pair. The final decision regarding visas and residence permits always rest with the IND.
4. Registration & Application
Host families and au pairs must provide complete, truthful and accurate information during the registration and application process.
The Agency reserves the right to reject applications without providing detailed reasons.
Providing false, misleading or incomplete information may result in immediate termination of services.
5. Host Family Responsibilities
The host family agrees to:
• Comply with Dutch au pair regulations
• Provide a safe and respectful living environment
• Provide a private bedroom and daily meals
• Respect maximum working hours and duties permitted by law
• Arrange appropriate health insurance
• Treat the au pair respectfully and without discrimination
• Encourage cultural exchange and support the Au Pair’s integration into family life.
Failure to comply with these obligations may result in the termination of the placement and the agency’s services.
6. Au Pair Responsibilities
The au pair agrees to:
• Respect the host family and household rules
• Participate in cultural exchange in good faith
• Complu with all Dutch laws and regulations
• Perform only permitted light household duties and childcare tasks
• Not engage in unauthorized paid or unpaid work outside the host family
• Communicate openly and repectfull with the host family and the Agency.
Failure to comply with these obligations may result in the termination of the placement and the agency’s services.
7. Fees & Payments
All agency fees, placement fees and administrative costs must be paid according to the agreed payment schedule.
Unless otherwise agreed in writing:
• Registration fees are non-refundable
• Placement fees become non-refundable once a successful match has been confirmed
• Additional governmental or third-party costs are the responsibility of the applicable party
• All invoices must be paid within 14 calendar days of the invoice date.
• The agency reverses the right to suspend or terminate its services in the event of late or nonpayment
Any outstanding amounts remain payable, even if the placement is cancelled due to circumstances beyond the agency’s control.
8. Replacement & Rematch Policy
Nest AuPair Agency is committed to making every placement as succesfull as possible. The agency will make every reasonable effort to create a strong and suitable match by establishing clear expectations, schedules and agreements in advance.
In the event of a serious mismatch during the placement period, the agency will first provide guidance and mediation to help both parties resolve any issues.
When necessary, the agency may assist in arranging a replacement Au pair or Host family.
A replacement is not guaranteed and depends on:
• Availability of suitable candidates
• Circumstances of termination
• Compliance with Agency policies and procedures
• Cooperation of both parties
The agency will always aim to find a fair and practical solution in the best interest of all parties involved.
9. Termination
The Agency reserves the right to terminate services immediately in cases involving:
• Abuse, exploitation or neglect.
• Violence or threats
• Fraud, misrepresentation or the provision of false information.
• Violation of Dutch au pair regulations
• Illegal employment or unauthorised work.
• Unsafe or unsuitable living conditions
• Serious misconduct by any party
The Host family or Au Pair may also terminate the placement by providing written notice to end the agency.
Termination of a placement does not automatically entitle any party to a refund of fees already paid.
The agency will, where possible, provide guidance and support to ensure that the termination process is handled respectfully and in accordance with applicable laws and regulations.
10. Liability
The Agency acts solely as an intermediary and support provider between the host family and the au pair.
The Agency shall not be held liable for:
• Personal conflicts or disagreements between parties
• Behavioural, emotional or compatibility issues
• Visa refusals, delays or changes in immigration regulations.
• any Indirect, incidental or consequential damages
• Decisions made by governmental authorities including the IND.
• Travel disruptions orcircumstances beyond the agency’s control.
The agency’s total liability shall, under all circumstances, be limited to the amount of fees paid by the host family for the specific placement.
The agency will make every reasonable effort to provide professional guidance and support but cannot guarantee the success of any placement.
11. Privacy & Data Protection
The agency processes personal data in accordance with the General Data Protection Regulation (GDPR/AVG) and applicable Dutch privacy laws.
Personal information may be collected and used for:
• Matching procedures
• Visa and administrative processes
• Communication regarding placements
• Compliance with Legal and regulatory obligations
The agency will take appropriate measures to protect personal data and will not share personal data information with third parties unless required by law or necessary to provide its services.
All parties agree to treat personal and confidental information obtained during the placement process with care and confidentiality.
12. Force Majeure
The Agency shall not be held responsible for delays, cancellations or failures to perform its services due to circumstances beyond its reasonable control, including but not limited to:
• Governmental decisions or policy changes
• Immigration or visa delays
• Pandemics or public health emergencies.
• Natural disasters
• War, civil unrest or strikes.
• Transportation disruptions
• Technical failures or other unforeseen events.
In such circumstances, the Agency will make every reasonable effort to minimise disruptions and keep all parties informed. However, no compensation or refund shall be due for delays or cancellations caused by force majeure.
13. Complaints & Mediation
If any concerns, disputes or misunderstandings arise during the placement period, all parties agree to first attempt to resolve the matter through respectful communication and mediation.
Complaints must be submitted in writing to the Agency and include a clear description of the issue.
The agency will review the complaint and make every reasonable effort to facilitate a fair and practical solution.
If a resolution cannot be reached through mediation, the parties may pursye further legal action in accordance with applicable Dutch law.
14. Applicable Law
These General Terms & Conditions shall be governed and interpreted exclusively in accordance with Dutch laws. Any disputes arising from or relating to the agency’s services, placements or agreements shall be submitted to the competent court in the Netherlands.
The agency operates in accordance with applicable Dutch laws, regulations and IND requirements governing the Dutch au pair programme.
By using the agency’s services, all parties agree to comply with these General Terms & Conditions.
